Welcome to Printabotic. These Terms of Service ("Terms") govern your access to and use of the Printabotic website at printabotic.com (the "Site"), operated by Kiss My Pixels LLC ("Company", "we", "us", "our"), including all products, services, design tools, and features offered through the Site (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to use our Services. By using the Site, you represent that you meet this requirement.
2. Account Registration
Some features require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
3. Products and Services
Printabotic offers custom-printed products including banners, flags, table throws, trade show displays, event tents, and other promotional materials. We provide multiple ways to create your design: a Self-Service Design Tool, a Professional Design Service, and a Design-Only Service (design files without printing).
4. Pricing and Payment
All prices are in US Dollars. Prices are subject to change without notice. Payment is due at time of order. We accept major credit cards and other payment methods as indicated at checkout. Discounts and promotional codes cannot be combined; only one discount applies per order, and any automatic discount is replaced when a promo code is used.
5. Order Acceptance
Your placement of an order constitutes an offer to purchase. We reserve the right to accept or reject any order for any reason, including but not limited to content that may violate our Content Policy or these Terms.
6. User Representations and Warranties
By uploading any content to our Site or submitting any design materials, you represent and warrant that:
- (a) You are the owner of all intellectual property rights in the content, or you have obtained all necessary licenses, permissions, and consents from the rightful owner(s) to use such content for the purpose of creating printed products;
- (b) Your content does not infringe, misappropriate, or violate any third-party intellectual property rights, including but not limited to copyrights, trademarks, trade dress, patents, or rights of publicity;
- (c) You have the legal authority to grant Printabotic a limited, non-exclusive license to reproduce, modify, and print your content solely for the purpose of fulfilling your order;
- (d) Your content does not contain any material that is unlawful, defamatory, obscene, threatening, or otherwise objectionable;
- (e) If you are uploading content on behalf of a business or organization, you are authorized to act on their behalf and bind them to these Terms.
7. Design Approval
For Self-Service Orders: The system generates a print-ready file from your design. You approve the design as shown in the preview. Printabotic is not responsible for design errors made by the customer, including but not limited to typos, low-resolution images, color choices, or layout decisions.
For Professional Design Orders: You must explicitly approve the final proof before printing begins. Once approved, you accept responsibility for the design as shown.
8. Design Review
Printabotic reserves the right, but assumes no obligation, to review designs before production for quality and content compliance. Such review is conducted at our sole discretion and does not constitute endorsement, verification, or approval of the content. A review does not create any liability on Printabotic's part for content that passes review. We may refuse or cancel any order at our sole discretion if we believe content may infringe third-party rights, contain prohibited content, or violate these Terms.
9. Color Disclaimer
Colors displayed on your screen may vary from the actual printed product. Minor color variations are inherent in the printing process and are not considered defects.
10. AI-Powered Tools Disclaimer
AI-powered tools (including background removal and generation) are provided as creative aids. AI-generated content may occasionally resemble existing works. You are solely responsible for reviewing and approving all AI-generated content before placing your order. Printabotic is not liable for any claims arising from your use of AI-generated content.
11. Intellectual Property
All Site content, trademarks, logos, and software are the property of Printabotic or its licensors and are protected by US and international intellectual property laws. Designs created by you remain your intellectual property, subject to third-party rights. Designs created by our professional design team are licensed to you for the specific products ordered; source files remain Printabotic's property.
12. Prohibited Content
You may not use our Services to create, produce, or distribute content that is illegal, defamatory, obscene, threatening, harassing, infringing on third-party intellectual property rights, or otherwise objectionable. See our Content Policy for detailed guidelines. We reserve the right to refuse any order containing prohibited content without liability.
13. Indemnification
You agree to indemnify, defend, and hold harmless Kiss My Pixels LLC d/b/a Printabotic, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- (a) Your content, designs, or materials uploaded to or used through the Services;
- (b) Your violation of these Terms or any applicable law;
- (c) Your violation or infringement of any third-party rights, including intellectual property rights, privacy rights, or rights of publicity;
- (d) Any claim that your content caused damage to a third party.
This indemnification obligation shall survive the termination of your account and these Terms.
We may, at our own expense, assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you will cooperate in asserting available defenses and will not settle any such matter without our prior written consent. This indemnification also extends to our payment processors and hosting and infrastructure providers, and their respective officers, directors, employees, and agents.
14. Account Suspension and Termination
We may suspend or terminate your account and refuse any current or future use of the Services if you: (a) violate these Terms; (b) are subject to multiple valid intellectual property complaints; (c) upload content that repeatedly violates our Content Policy; or (d) engage in fraudulent or abusive behavior. Account termination does not relieve you of your obligations under these Terms, including indemnification.
15. Fee Retention
If an order is cancelled or refused due to Content Policy or intellectual property violations after production has begun, design fees and production costs already incurred are non-refundable. If an order is refused before production begins, any payments made will be refunded minus applicable design fees for work already performed.
16. Limitation of Liability
To the maximum extent permitted by law, in no event shall Printabotic, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, licensors, suppliers, payment processors, or hosting providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, regardless of the theory of liability and even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to these Terms, the Services, or any file, design, or product we provide shall not exceed the total amount you actually paid to us for the specific order giving rise to the claim. Your sole and exclusive remedy for any dissatisfaction with the Services, any delivered file, or any product is, at our option, correction of the file, re-performance, or a refund of the amount you paid for that order.
Some jurisdictions do not allow the exclusion or limitation of certain damages or the limitation of liability for certain claims (such as those for personal injury, fraud, gross negligence, or willful misconduct), so some of the above may not apply to you; in such cases our liability is limited to the smallest amount permitted by law.
17. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, Printabotic expressly disclaims all warranties, whether express, implied, or statutory, including the implied warranties of title, non-infringement, merchantability, and fitness for a particular purpose. We do not warrant that the Services will be uninterrupted or error-free, that content submitted by users does not infringe third-party rights, or that user-generated designs are accurate, original, non-infringing, or fit for any print or commercial purpose. Color may vary between on-screen display and printed output, and between print runs and substrates; resolution and final print quality depend on the files and images you provide. You assume all risk arising from your design choices. This disclaimer applies equally to any print-ready files we generate or deliver to you; we do not warrant that such files are fit for any particular printing process, printer, material, or purpose.
18. File Specifications & Print Verification
Downloaded print-ready files include CMYK PDFs prepared for printing (a bleed version for your printer and a version trimmed to final size), an editable vector SVG, and a PNG preview. Designs created by our professional design team (design service) are delivered as print-ready files as well.
You are solely responsible for verifying that any print-ready file we generate or deliver to you (including CMYK PDFs, vector SVG, PNG previews, and any files produced by our Self-Service Tool or Professional Design Service) is suitable for your intended print method, printer, material, and final size before printing. Where you print our files yourself or through any third-party print provider, Printabotic is not responsible for, and disclaims all liability for, the final printed result — including any defects, errors, color differences, blurriness, pixelation, banding, cropping, or other quality issues that appear after printing. You agree to obtain a physical proof and to confirm color, resolution, bleed, trim, dimensions, and file compatibility with your printer before committing any file to production.
You acknowledge that certain design elements — including photographs, uploaded images, background gradients, and other raster (non-vector) content — are resolution-dependent and may display visible banding, softness, or pixelation when printed, particularly at large format or large scale. This is an inherent characteristic of such content and is not a defect.
Delivered files are generated exactly from the design you approved on screen. We make no warranty that any delivered file is error-free or fit for any particular printing process, printer, material, or purpose, and your use of any delivered file is entirely at your own risk. Any correction we may choose to offer is at our sole discretion and creates no obligation.
19. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, where Kiss My Pixels LLC is organized, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding, individual arbitration administered in accordance with the rules of the American Arbitration Association.
Class Action & Jury Trial Waiver. You and Kiss My Pixels LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. You waive any right to a trial by jury and any right to participate in a class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding. If this Class Action & Jury Trial Waiver is found to be unenforceable, then the entirety of the arbitration provision shall be null and void as to the affected claims, which shall instead proceed exclusively in the state or federal courts located in Sheridan County, Wyoming, and you and Kiss My Pixels LLC consent to the personal jurisdiction and venue of those courts.
20. Chargebacks & Payment Disputes
If you initiate a chargeback, payment reversal, or dispute for a transaction that was properly authorized and not the result of fraud against you, you agree to reimburse Printabotic for the disputed amount together with any associated processing or bank fees, and to indemnify us for related collection and legal costs. We may suspend or permanently close any account associated with improper chargebacks, withhold delivery of files or services pending resolution, and pursue any amounts owed.
21. Account Security & Data Loss
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. To the maximum extent permitted by law, Printabotic is not liable for any loss or damage arising from unauthorized access to your account, your failure to safeguard your credentials, or the loss, corruption, or deletion of designs, drafts, or files (including following account suspension, termination, or discontinuation of the Services). You are responsible for retaining your own copies of any files you download.
Download credits. Download credits are a promotional allowance, not a product. They have no cash value, are non-transferable and non-refundable, are consumed when a print-ready file is unlocked (whether or not you download it), and we may change or end the program at any time. A file unlocked with a credit may be downloaded again without a further credit; a changed design is a new file. Any restoration of a credit is at our sole discretion.
22. Export & Sanctions Compliance
You represent and warrant that you are not located in, organized under the laws of, or ordinarily resident in any country or region subject to comprehensive U.S. embargoes or sanctions, that you are not a person or entity identified on any U.S. government restricted-party or sanctions list (including the OFAC Specially Designated Nationals list), and that you will not use the Services in violation of any applicable export-control or sanctions laws. We may refuse or cancel any order to comply with these laws.
23. Legal Disclosures
We may access, preserve, and disclose your account information and content if we are required to do so by law or legal process, or if we believe in good faith that such action is reasonably necessary to comply with legal obligations, enforce these Terms, respond to claims that content violates the rights of third parties, or protect the rights, property, or safety of Printabotic, our users, or the public. Where permitted by law, we may take such action without prior notice to you.
24. Changes to Terms
We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date. Continued use of the Services after changes constitutes acceptance of the revised Terms.
25. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. In particular, if any limitation of liability, disclaimer of warranty, or limitation of remedy is held unenforceable in whole or in part, all other limitations, disclaimers, and exclusions shall remain in effect to the fullest extent permitted by law.
26. Production Tolerances
For printed products, minor variations are inherent in custom manufacturing and are not defects. By placing an order you accept commercially reasonable tolerances, including minor variations in color, size or dimensions, trim and bleed position, material, and finish, and minor variation in quantity (we may deliver and bill within a reasonable range of the quantity ordered). Color is not guaranteed to match any on-screen display, prior order, sample, or any specific brand or Pantone reference unless a paid color-matching service is expressly agreed in writing.
27. Turnaround, Delivery & Delays
Any production, turnaround, shipping, or delivery dates we provide are estimates only and are not guaranteed, and time is not of the essence. We are not liable for any delay in production or delivery, or for any loss, cost, or damage (including missed events, deadlines, or opportunities) arising from such delay, including delays caused by carriers, payment processing, content or file issues, or circumstances beyond our reasonable control. Responsibility for meeting any event or deadline rests with you; we recommend ordering well in advance.
28. Force Majeure
We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, fire, flood, epidemic or pandemic, war, terrorism, civil unrest, labor disputes, governmental action, utility or internet failures, supplier or carrier failures, equipment or material shortages, or other force majeure events.
